MikvaTech
International · Version 1 · Effective 18 October 2026
These Terms & Conditions (the “Terms”) govern the MikvaTech Essential Care Plan (the “Plan”) offered by MikvaTech Pool Purity Ltd. (together with its affiliates, “MikvaTech”) to the client identified in the applicable invoice, order confirmation, or enrollment form (the “Client”). These Terms apply to Plans for mikvaot located outside Israel; Plans for mikvaot in Israel are governed by separate terms. Enrollment in the Plan (including by accepting these Terms on an enrollment form), payment of any Plan fee, or acceptance of any benefit under the Plan each constitutes the Client’s acceptance of these Terms, whether or not a separate acknowledgment has been completed.
The Plan is a maintenance and coverage subscription for the MikvaTech water-purification system or systems installed at a single mikva (the “Covered Systems”). Each Covered System comprises its filter unit or units together with its oxidation unit or control box, as applicable, and their associated components.
MikvaTech systems are engineered to operate up to a maximum of ten (10) hours per day and are not designed for continuous or around-the-clock operation. This limit applies to every model.
Operation in excess of ten (10) hours per day falls outside normal use and voids coverage under the Plan, and may also void any separate warranty on the equipment. Continuous operation shortens component life and increases the likelihood of overheating and malfunction.
The Client shall provide the system’s operating-hour reading to MikvaTech on request. Operating hours may be ascertained by means of the on-unit hour counter or by any other means available to MikvaTech, and MikvaTech may decline any claim where the recorded or ascertained operation exceeds this limit.
The Plan is offered in tiers, each denominated by the number of replacement filter cartridges furnished per filter unit per year. The tier applicable to the Client is that stated in the Client’s invoice, order confirmation, or enrollment form.
| Tier | Cartridges per filter unit per year |
|---|---|
| ECP-12 | Twelve (12) |
| ECP-6 | Six (6) |
| ECP-4 | Four (4) |
| ECP-3 | Three (3) |
| ECP-2 | Two (2) |
| ECP-1 | One (1) |
MikvaTech schedules cartridge shipments, which may be furnished periodically or in one or more consolidated shipments covering more than one replacement interval.
Subject to the conditions in Section 5 and the exclusions in Section 6, and provided the Plan is in effect and the Client’s account is current, the Plan affords the following in respect of the Covered Systems:
Coverage is not limited to an enumerated list of components; it extends to the Covered Systems generally, on the basis that the cause originates in the system itself. The motor, oxidation generator, and certain other components are wear components that are not designed to last indefinitely and will, in the ordinary course, require periodic replacement as part of routine maintenance.
A Client who enrolls in the Plan together with the initial order of the Covered System, or upon upgrading an FLT-model filter to the FLTM model, is furnished with one spare motor to be kept on hand at the mikva and, whenever that spare motor is put into use, with a replacement spare motor, so that a spare motor remains on hand for as long as the Plan remains in effect. A Client who enrolls at any other time is not entitled to a spare motor; motors are then repaired or replaced only as set out above.
Coverage extends only to replacements arising in the ordinary course under normal use, and is conditioned upon the Client:
Coverage does not extend to any malfunction, damage, deterioration, or requirement for replacement whose cause does not originate in the Covered System itself. Without limitation, the Plan does not cover anything caused by or relating to:
MikvaTech may, in its discretion, accept enrollment of equipment with a known pre-existing condition; any such condition remains excluded and must be addressed separately unless MikvaTech agrees otherwise in writing.
Standard shipping of items furnished under the Plan is included for Covered Systems located within the United States. For Covered Systems located outside the United States, shipping is not included, and all shipping, freight, customs, duties, taxes, and related charges are invoiced separately to the Client.
Installation, on-site labor, and technician attendance are not included within the Plan. MikvaTech may, at its sole discretion and as a courtesy, perform labor or dispatch a technician in connection with a covered part at no charge; doing so on any occasion creates no obligation to do so on any future occasion.
The Plan is issued in respect of a single mikva and extends to all MikvaTech systems installed at that mikva. Enrollment of fewer than all systems at a given mikva is not available.
The removal, sale, transfer, or decommissioning of any Covered System modifies or terminates the Plan accordingly. A separate mikva, or any system relocated to a different mikva, requires independent enrollment. The Plan is personal to the Client and the Covered Systems and may not be assigned without MikvaTech’s prior written consent.
The Client is solely responsible for notifying MikvaTech of any change in the number or composition of the Covered Systems, including any change that might warrant a reduction in the Plan fee. MikvaTech bears no liability for any such change of which it has not been notified, is under no obligation to adjust the Plan retroactively, and shall not refund or credit any amount previously paid; all amounts paid prior to such notice are deemed fully earned and non-refundable. Fee adjustments take effect prospectively only.
The Plan fee and billing frequency are stated in the Client’s invoice, order confirmation, or enrollment form, and are exclusive of applicable taxes. The Client authorizes MikvaTech and its payment processors to charge the designated payment method, or to collect by standing order where applicable, the recurring Plan fee plus taxes on each billing date, on a continuing basis, until the Plan is terminated under Section 10.
Plan charges are processed by MikvaTech Pool Purity Ltd., may be processed outside the Client’s country, and may appear on the Client’s statement under that name. Any foreign-transaction or currency-conversion fee charged by the Client’s card issuer is the Client’s responsibility.
The Plan fee is not fixed for the life of the Plan, and MikvaTech may adjust it from time to time, provided that: (a) no adjustment applies retroactively or to a billing period already invoiced or paid; (b) MikvaTech gives the Client not less than thirty (30) days’ advance written notice, sent to the email or billing address on file, stating the adjusted fee and the date on which it takes effect; and (c) the adjusted fee takes effect only from the first billing date falling after the end of that notice period.
A Client who does not wish to continue at the adjusted fee may cancel the Plan under Section 10 at any time before the adjusted fee takes effect, in which case the adjusted fee will not be charged. Continued participation in, or renewal of, the Plan on or after the effective date of the adjustment constitutes acceptance of the adjusted fee. Where applicable law requires a longer notice period, a particular form or manner of notice, or the Client’s express consent to a fee change, MikvaTech will comply with that requirement.
If a scheduled charge is not successfully processed, the unpaid amount accrues, and where the card network or processor automatically updates the payment credentials the charge is reattempted automatically. Upon a valid payment method becoming available, the entire accrued balance is charged in a single transaction. The accrued balance is not apportioned over later billing periods and is not extinguished by lapse of time.
A grace period of one (1) month applies to any unpaid Plan fee, during which the Plan remains in effect. If payment is not brought current by the end of the grace period, the Plan and all benefits are suspended; during suspension no consumables, parts, or coverage are furnished, and no replacement arising in that period is covered. Upon payment being brought current, MikvaTech invoices for the lapsed period and then furnishes any scheduled items that fell due during the lapse, restoring the Client to the original schedule.
The Plan start date is the date stated in the Client’s invoice, order confirmation, or enrollment form or, where none is stated, the date on which MikvaTech activates the Plan, unless a delayed start applies.
Where the Client indicates at enrollment that the mikva is not yet operational, billing, the cartridge schedule, and coverage under the Plan do not begin at enrollment. The Plan start date is then the earlier of (a) the date on which the Client notifies MikvaTech that the Covered System is in use, and (b) the date on which the Covered System is first put into use, and MikvaTech may charge the Plan fee from that date. The Client shall notify MikvaTech promptly once the Covered System is put into use. A delayed start applies to the Plan only and does not affect any separate warranty on the equipment.
The Plan renews automatically. Whether the Client is billed monthly, quarterly, or annually, the Plan and the corresponding charges continue automatically for successive periods at the then-prevailing rate until cancelled under these Terms or unless otherwise agreed in writing.
The Client may cancel at any time. On cancellation the Client has no entitlement to any item not yet due; any item scheduled for a future date is furnished only if the Client remains enrolled when that date arrives; all amounts then due, including any accrued balance, remain payable; and no refund is due for elapsed service periods except as required by law.
Where the Client received an enrollment benefit, discount, or complimentary item in connection with joining the Plan, the Client shall maintain the Plan for a minimum of twelve (12) months from the Plan start date. On early cancellation the Client’s payment method or standing order will be charged for the remaining months of that minimum, and if the charge cannot be collected the Client remains liable for those amounts.
MikvaTech may suspend or terminate the Plan for non-payment, fraud or material misrepresentation, breach of these Terms, or the removal, sale, transfer, or decommissioning of the Covered Systems. MikvaTech may modify these Terms for future periods upon prior notice as required by law; continued participation or renewal after the effective date constitutes acceptance. Changes to the Plan fee are governed by Section 9.
MikvaTech may effect any replacement using new, used, or refurbished parts of equivalent functionality, or substitute an equivalent or improved component where the original is unavailable. MikvaTech is not liable for delay caused by parts unavailability or supply-chain conditions beyond its reasonable control.
The Essential Care Plan is a service plan and is not a representation, warranty, or guarantee as to any performance characteristic or result of the Covered Systems.
To the maximum extent permitted by law, MikvaTech’s total liability arising out of or relating to the Plan shall not exceed the Plan fees paid in the twelve (12) months before the claim arose, and MikvaTech shall not be liable for any indirect or consequential loss, including loss of use, water damage, mold, business interruption, or downtime of the mikva.
Nothing in this section limits liability for personal injury or death caused by MikvaTech’s negligence, for fraud, or for any liability that may not be limited under applicable law.
The Client shall indemnify and hold MikvaTech harmless from third-party claims arising from the Client’s misuse of the Covered Systems, breach of these Terms, or unauthorized modification or servicing, save to the extent caused by MikvaTech’s gross negligence or willful misconduct. MikvaTech is not liable for any delay or failure to perform caused by events beyond its reasonable control.
Nothing in these Terms derogates from any right that may not be waived under the mandatory law applicable to the Client. If any provision is unenforceable, the remainder continues in effect.
These Terms, together with the Client’s invoice, order confirmation, or enrollment form, are the entire and final agreement regarding the Plan, and supersede all prior and contemporaneous communications, correspondence, quotations, proposals, marketing materials, and representations relating to it. Any summary description of the Plan is a general description only; the coverage and benefits are exclusively those set out here, which govern in the event of any inconsistency.
